General Terms and Conditions of La Bella Archo Interiors’ Interior Design Service
1. Contract Formation
These Terms and Conditions, together with the estimate of works (“Estimates”) provided by La Bella Archo that describes the services, constitute the entire contract between La Bella Archo and you (the “Client”), and will apply once an appointment has been made to provide La Bella Archo services (the “Services”).
You should carefully read these terms and conditions before purchasing the Services. Do not use the Services if you do not agree with them.
2. La Bella Archo Work Scope
La Bella Archo has been hired solely to provide interior design services. La Bella Archo is not a general contractor and will not act as one. Any construction-related issues must be discussed between the owner and his or her contractor.
La Bella Archo will make every effort to inform the client of the anticipated timeframe of works as soon as possible after the quotes have been produced. All such dates are only estimates, and La Bella Archo cannot be held liable for any delays in completion.
La Bella Archo is in charge of organizing Third Party companies, firms, or individuals (“Third Party Suppliers”) to perform specific work for the Client, such as decorating, building work, carpet fitting, curtain and blind manufacture and fitting, and such other work as La Bella Archo confirms.
We cannot guarantee that Clients will always like our recommendations due to the nature of the Interior Design business. Interior design is highly subjective. In this case, we are unable to provide refunds. However, if you contact La Bella Archo, we will be happy to discuss the design concept further over the phone and, in special cases, make additional recommendations via phone/email.
3. Customer Obligation
Throughout the duration of the works, the Client must ensure that the property is accessible to La Bella Archo employees and any third-party suppliers providing services. The client will ensure that utilities such as electricity and water are available for use at the property throughout works and at no cost to La Bella Archo Interiors.
4. Rental Product Purchase
La Bella Archo may need to purchase products for the Client on occasion in addition to the scope of work already proposed. In such cases, the Client must pay the agreed-upon purchase price in full before purchasing the agreed-upon products.
When renting furniture or accessories, it is the Client’s responsibility to insure the furniture and accessories against all risks, damage, or loss.
5. Third-Party Vendors
The Client will enter into contractual relationships with Third Party Suppliers and will be responsible for managing these relationships as well as any direct financial settlements with Third Party Suppliers.
As part of the service, La Bella Archo may coordinate services and financial settlements with Third Party Suppliers on their behalf, but the Client is ultimately responsible for the contractual relationship with the Third Party Supplier.
La Bella Archo is not obligated to form any contractual relationship on the client’s behalf.
6. Payment and Billing Conditions
The fees for the services are detailed in the Estimate that is included with these terms and conditions, or as amended or updated by La Bella Archo and communicated to the Client.
Payment should be made in cash or by check, with a guarantee card or bank transfer to back it up.
All checks should be made payable to La Bella Archo or, unless otherwise specified by La Bella Archo Interiors.
All payments to La Bella Archo are due immediately upon presentation of the invoice, unless the invoice is sent via post, in which case payments are due within 5 working days of the invoice date.
If La Bella Archo is forced to use a debt collection agency or initiate legal proceedings, the Client will be held liable for any costs incurred.
7. Policy on Cancellation and Termination
Subject to the provisions below, the Client has the right to cancel this contract (the “Contract”) at any time up to the end of seven working days after the day on which the Contract is concluded. A working day is defined as any day that is not a weekend or a bank or other public holiday.
If the supply of the Service begins with the Client’s agreement before the end of the seven working day cancellation period, the Client has no right to cancel the Contract. To exercise the right to cancel set forth in clause 7.1, the Client must provide written notice to La Bella Archo by hand, post, or email at the address or email address set forth in clause 9.2 below.
Once the client has notified La Bella Archo that they are cancelling the Contract, La Bella Archo will refund the Client for the Services within 30 days.
Following the seven-day period specified in clause 7.1, the client has the option to terminate the contract at any time by providing written notice to La Bella Archo. The Client will be obligated to pay La Bella Archo for services rendered up to the date of termination (including, but not limited to, Services already performed, goods and materials supplied or ordered on the Client’s behalf, any services that may incur cancellation fees, and any travel or accommodation costs incurred by La Bella Archo Consultants).
A delay in acting on a breach of this contract by either party will not be considered a waiver of the breach. If either party waives the other party’s breach of the Contract, the waiver is limited.
Contract termination has no effect on either party’s outstanding rights or duties, including La Bella Archo’s right to recover any money owed to it under these terms and conditions.
8. Legal responsibility
La Bella Archo shall have no liability to the Client for any loss, damage, costs, expenses, or other claims for compensation arising from any incomplete, incorrect, or inaccurate information or instructions supplied by the Client.
La Bella Archo will not be liable to the Client for any unforeseeable loss or damage resulting from the provision (or non-provision) of the Services, including lost profits or consequential loss or damage.
Neither La Bella Archo nor the client shall be liable for any failure to perform its obligations under this Contract as a result of any cause.
9. Data Security
Unless the client agrees otherwise, La Bella Archo will only use personal information provided by the Client for the purpose of providing the Services or informing the client of the availability of similar services.
By giving La Bella Archo written notice, the Client can correct any information or request that information about the Client be delayed.
We have taken every precaution to prevent internet fraud and to ensure that the information we collect from you is stored as securely as possible. We cannot, however, be held liable in the event of a breach in our secure computer servers.
10. Copyright
The copyright, design right, and all other intellectual property rights in any materials and other documents or items prepared or produced for the Client by or on behalf of La Bella Archo in connection with the Services shall be and remain the sole property of La Bella Archo, and any such materials, documents, or items shall be and remain the sole property of La Bella Archo.
La Bella Archo may use photographs of the Client’s property demonstrating the Services provided by La Bella Archo for its own marketing purposes.
